TPsign Terms of Service

Preliminary Remarks

TPsign is a legally binding electronic signature application provided by TrustPro QTSP Ltd, a Qualified Trust Service Provider (QTSP) authorised in the EU to issue Qualified Electronic Signature (QES) certificates. Users without existing TrustPro QTSP credentials (“pen”) will be redirected to TrustPro QTSP’s online smartOnboarding platform for identity verification before accessing and using TPsign.

Your access to and use of TPsign are subject to your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the TPsign Service.

By using TrustPro QTSP’s websites, applications, software, services, products, and other properties, you agree to these Terms of Service and our Privacy Policy.

These Terms of Service, together with our Privacy Policy and any additional agreements entered into (collectively, “TrustPro QTSP Terms”), govern your use of the TPsign website, web and mobile applications, software, services, materials, and other TrustPro QTSP properties (collectively, “TrustPro QTSP Services”). TrustPro QTSP Ltd (“we,” “us,” “our”) provides these Services to you (“you,” “your,” “user”).

By accessing, using, or downloading TPsign, you confirm your explicit acceptance of these Terms. If you do not accept these Terms, you must not use the TPsign Service.

If you are accepting these Terms on behalf of an entity, you represent that you are authorized to bind that entity to these Terms. In such cases, “you” refers to the entity.

If there is a conflict between these Terms and any separate agreement between you and TrustPro QTSP (e.g., for timestamps, electronic seals), the separate agreement will prevail.

Use of TPsign Service

To use TPsign, you must have a valid TrustPro QTSP user ID.

When signing documents through TPsign, you use a Qualified Electronic Signature (QES) compliant with the EU’s eIDAS Regulation, recognized throughout the European Union.

TrustPro QTSP is not responsible for determining whether any document signed via TPsign qualifies under specific jurisdictional rules for electronic signatures. You should consult legal counsel regarding the validity of your documents.

Identity verification of TPsign users is conducted by TrustPro QTSP via smartOnboarding online platform and you must provide accurate data to ensure successful verification.

Electronic Document Retention

TPsign does not retain documents permanently.

Documents remain accessible only during the active session unless explicitly downloaded, saved, deleted, or changed by the user.

Assignments of Rights

TrustPro QTSP grants you a personal, limited, non-exclusive, non-transferable license to use TPsign as per these Terms. You may display, copy, distribute, and download content from TPsign provided you:

  • Retain all copyright and proprietary notices;
  • Use the content solely for personal or business use;
  • Do not modify the content.

We reserve the right to suspend or terminate your access if your use appears abusive or unduly burdensome.

Violation of these Terms may result in immediate suspension and potential legal liability.

Your Content

You retain ownership of all content you upload, post, or share through TPsign.

  • You are solely responsible for:
  • The legality and appropriateness of your content;
  • Compliance with applicable data protection laws;
  • Ensuring no prohibited “special category data” (e.g., race, religion, health data under GDPR) is shared.

By uploading content, you warrant that you:

  • Own or have the rights to the content;
  • Do not violate any third-party rights.

We may use your content only to deliver our services. We assume no liability for user-generated content.

Warranty and Liability

TPsign is provided “as is” and “as available”.

To the maximum extent permitted by law, TrustPro QTSP disclaims all warranties, including:

  • Non-infringement;
  • Merchantability;
  • Fitness for a particular purpose.

We do not guarantee that TPsign:

  • Will meet your specific needs;
  • Will be continuously available, timely, secure, or error-free;
  • Will produce accurate or reliable results.

In no event will TrustPro QTSP or its affiliates be liable for indirect, incidental, consequential, or punitive damages.

Our liability is limited to the total amount paid by you in the four months preceding the incident, except in cases of intent or gross negligence.

Account Confidentiality

You are responsible for maintaining the confidentiality of your TPsign account and password. Notify us immediately of any security breach.

TrustPro QTSP is not responsible for losses arising from unauthorized use of your account.

Unauthorized access attempts (e.g., hacking, password mining) are strictly prohibited.

API Access

TrustPro QTSP provides APIs via its multiSign framework for integration purposes. API usage may be subject to volume limits, depending on your subscription.

TrustPro QTSP provides API (Application Programming Interface) through the multiSign framework for e-Signature service integration. API usage can be limited (e.g. maximal n API calls per account per hour) depending on your agreement/subscription.

Communications

By creating a TPsign account, you consent to receive communications from us, including marketing emails. You can unsubscribe at any time.

Modification and Suspension

We reserve the right to suspend or terminate your account for violations of these Terms or excessive use.

If your usage becomes burdensome to our systems, we may require you to upgrade to an appropriate subscription plan.

We will notify you reasonably in advance before suspending services, where possible.

Large files (over 10MB) may impact signature performance.

General Provisions

Governing Law: Irish law governs these Terms.

Dispute Resolution: All disputes must be resolved exclusively in Dublin courts.

Binding Agreement: These Terms constitute a legally binding agreement.

Language: The English version of these Terms prevails in case of discrepancies.

Ideas and Suggestions: Any feedback you provide grants us a royalty-free, worldwide, perpetual license to use it.

Free Trial

You may access a free trial of TPsign without providing a payment method. No automatic subscription will follow.

TrustPro QTSP reserves the right to cancel or modify the free trial without notice.

Changes to Terms

We may amend these Terms at any time. If we make material changes, we will provide at least 30 days’ notice.

Continued use of TPsign after changes take effect constitutes your acceptance of the new Terms.
